第一章 总 则
第一条 为了保证公用电信网的安全性、可靠性，提高公用电信网中主
要电信设备的抗震性能，根据国家有关规定，制定本办法。
第二条 本办法适用于进入我国抗震设防烈度7烈度以上（含7烈度）地
区的公用电信网的交换、传输、移动基站、通信电源等主要电信设备的抗震性能检测管理。
第三条 凡在我国抗震设防烈度7烈度以上（含7烈度）地区的公用电信
网上使用的主要电信设备必须经过抗震性能检测，并获得信息产业部颁发的电信设备抗震性能检测
合格证（以下简称“检测合格证”）。未获得检测合格证的电信设备，不得在抗震设防7烈度以上
（含7烈度）地区的公用电信网上使用。
第四条 信息产业部综合规划司具体负责全国电信设备抗震性能检测管
理工作。
各省、自治区、直辖市通信管理局依照本办法的规定，负责本行政区
的电信设备抗震性能检测管理和监督检查工作。
第二章 检测管理
第五条 电信设备抗震性能的具体检测工作，由信息产业部授权的通信
设备抗震性能质量监督检验机构（以下简称检验机构）负责。
第六条 检验机构应当依据国家标准、通信行业标准及信息产业部的有
关规定对电信设备进行抗震性能检测。
第七条 检验机构应当在完成检测工作后出具产品抗震性能检测报
告。
第八条 经信息产业部授权的受理机构具体负责受理检测合格证的申
请。
第九条 电信设备生产企业应当向受理机构提出书面申请。
书面申请应当包括下列内容：
（一）申请表一式两份（格式附后），申请表应当由生产企业法定代
表人或其授权人签字并加盖公章；境外电信设备生产企业应当委托中国境内的代理机构提交申请
表，并出具委托书；
（二）实行进网许可制度的电信设备，应当提交信息产业部颁发的进
网许可证，其他电信设备应当提交国家产品质量监督部门认可的产品质量认证报告或检测报告；
（三）通信设备抗震性能质量监督检验机构出具的电信设备抗震性能
检测报告。
第十条 自受理机构收到完备的申请材料之日起30日内，信息产业部综
合规划司对生产企业提交的申请材料审查完毕。经审查合格的，颁发检测合格证；经审查不合格
的，将申请材料退回受理机构，由受理机构通知生产企业。
第十一条 电信设备检测合格后，发生同种设备结构设计、焊接装配工
艺、材料等变化可能影响抗震性能的，生产企业应当在3日内向信息产业部综合规划司报告。
信息产业部综合规划司对因前款原因可能造成抗震性能降低的电信设
备,应当收回其检测合格证。生产企业应当按照本办法规定的程序重新办理检测和申请核发合格证
书手续。
第三章 监督管理
第十二条 信息产业部定期向社会公布获得检测合格证的电信设备和生
产企业。对获得检测合格证的电信设备进行抽查，并向社会公布抽查结果。
第十三条 生产企业获得检测合格证后，应当保证产品质量和性能稳
定。
第十四条 生产企业有下列行为之一的，由信息产业部给予警告；情节
严重的，收回其检测合格证或不再受理其检测合格证的申请：
（一）申请检测合格证时提供不真实申请材料的；
（二）获得检测合格证后降低电信设备抗震性能的。
第十五条 电信设备抗震性能检测报告、检测合格证不得伪造、冒用、
涂改和转让。
违反前款规定，伪造、冒用、涂改、转让检测合格证的，由省、自治
区、直辖市通信管理局给予警告，可以并处1万元以下的罚款，情节严重的，可以并处1万元以上3
万元以下罚款。对转让的检测合格证，由省、自治区、直辖市通信管理局收回。
第十六条 电信业务经营者不得在抗震设防7烈度以上（含7烈度）地区
的公用电信网中使用未获得检测合格证的电信设备。
违反前款规定的，由省、自治区、直辖市通信管理局责令其改正。
电信业务经营者使用未获得检测合格证的电信设备，造成经济损失
的，由有关部门依法追究有关人员的责任。
第十七条 检验机构及其工作人员，有下列行为之一的，由信息产业部
责令改正；情节严重的，取消对检验机构进行电信设备抗震性能检测的授权；构成犯罪的，依法追
究刑事责任：
（一）泄露被检设备的技术秘密的；
（二）出具虚假证明或者出具错误数据造成严重后果的。
第十八条 电信设备生产企业对检验机构出具的检测结论和检测收费有
异议的，或者认为检验机构的工作人员有违法违纪行为的，可以向信息产业部有关部门提出申诉。[!--empirenews.page--]
第十九条 从事检测合格证申请受理、审批的工作人员玩忽职守、滥用
职权、徇私舞弊的，依法给予行政处分；构成犯罪的，依法追究刑事责任。
第四章 附 则
第二十条 检验机构的收费标准，参照国家规定制定，并按规定的程序
报有关主管部门批准后执行。
第二十一条 本办法自2002年1月1日起施行。
